Marbury v. Madison

Marbury v. Madison, U.S. Supreme Court case decided in 1803. William Marbury sued James Madison, then secretary of state, for failure to deliver a federal appointment promised by the previous administration. Chief Justice Marshall held that the act upon which this case relied was unconstitutional. This was the first decision to invalidate an act of Congress and established the judicial right to review, greatly expanding the power of the judiciary.
